Brian Donnellan has a sizable lead in the race to become the next San Mateo County Superior Court judge, according to early election returns released Tuesday night.

Donnellan has 80.57% of the vote while his opponent, Jay Boyarsky, has 19.43%. The 9 p.m. update, released an hour after polling places closed on June 2, includes only vote‑by‑mail ballots received by the county elections office by Friday before Election Day and 764 in-person votes.

In all, 69,065 ballots have been counted so far, representing 15.44% of San Mateo County’s 447,306 registered voters, according to the county elections office.

The contest, on the ballot as the No. 4 seat, is the county’s first competitive Superior Court race since 2014. Judges are typically appointed by the governor and often run unopposed in subsequent elections, but the retirement of Judge Susan Greenberg created an open seat on the bench.

Both candidates have worked as prosecutors for more than 20 years. Donnellan is a deputy district attorney in San Mateo County, while Boyarsky serves as chief assistant district attorney of the Santa Clara County District Attorney’s Office.

Only in-person voting results will be added to the tally on election night, while mail-in ballots will be updated throughout the week. The elections office expects fewer than 10% of voters to cast their ballots at vote centers in this election.

The county received 74,957 vote‑by‑mail ballots before the cut-off to be counted on election night, which is fewer than half the 163,240 mail ballots cast in the 2022 primary election. The first updated tally that includes mail ballots that arrived after Friday is expected on Wednesday night. Since the cut off, the county has received an additional 33,000 vote-by-mail ballots. 

Only 764 ballots have been counted of the at-least 3,000 voter center ballots.

The tally is scheduled to be updated at 10 p.m.
